Special Needs Trusts/Guardianships

Montgomery County Attorneys: Special Needs Trusts and Guardianships

Attorneys at High Swartz LLP assist families in protecting vulnerable adults and minors through the use of special needs trusts and guardianships.

Disability and special needs trusts

We create disability trusts and special needs trusts, including living trusts and irrevocable trusts, on behalf of parents of children with disabilities, elderly couples who recognize they may need to finance nursing home care and those with chronic illnesses. When appropriate, we assist families in the development of family agreements or contracts – a method that can both save a property and other assets from extinction.

Elder Mediation

A senior family member's need for care or assistance on a regular basis puts a strain on the entire family. Through elder mediation, our attorneys assist families in creating workable solutions and plan for future needs. We can also assist when a family and a care giving facility is in crisis.

Guardianships

When an adult family member is not capable of making reasonable decisions, or a child with a developmental disability reaches adulthood, family members can petition the court to name an adult guardian. The guardian may have responsibility for the care of the person, the person's property or both. Our attorneys help families as they make those decisions, and in resolving disputes regarding appointment of a guardian or those regarding the actions of a guardian.
